Welcome to Chad Staton. These Terms of Service (“Terms of Service”) set out the rules for using https://chadstaton.store (the “Site”) and for buying products from Chad Staton (“we,” “us,” or “our”). Please read them carefully before using the Site or placing an order.

1. Acceptance of Terms

2. Eligibility and Account Responsibilities

Who May Use the Site

You must be at least 18 years old and legally able to enter into a binding contract to use the Site or place an order. By using the Site, you confirm that you meet these requirements. Financing through Affirm is also subject to Affirm’s own eligibility requirements.

Creating an Account

You may browse the Site without an account. If you create one, you agree to:

Give accurate, current, and complete information, and keep it up to date
Keep your username and password secure and confidential
Notify us right away at support@chadstaton.store if you suspect unauthorized use of your account
Accept responsibility for all activity that happens under your account

Suspension and Closure

We may suspend, restrict, or close any account, and cancel related orders, if we believe the account contains false information, breaks these Terms of Service, or is linked to fraud, abuse, or illegal activity.

3. Use of the Site and Limited License

Permission to Use the Site

We grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Site for your own personal, non-commercial purposes, such as browsing products and making purchases for yourself or as gifts.

What You May Not Do

This permission does not allow you to:

Copy, modify, distribute, sell, or lease any part of the Site or its content
Reverse engineer or attempt to extract the source code of the Site
Use the Site or its content to build a competing store or product database
Remove any copyright, trademark, or other ownership notices from Site content

Site Availability

We work to keep the Site available and running smoothly, but we do not promise that it will always be uninterrupted or error-free. We may change, suspend, or discontinue any part of the Site at any time, for maintenance or other reasons, without notice.

4. Products, Descriptions, and Pricing

Product Information

We try to describe and show our massage chairs as accurately as possible. However:

Colors may look different depending on your screen and device settings.
Dimensions, weights, and specifications are approximate and may vary slightly.
Massage intensity, comfort, and fit vary with body size, height, and personal preference.
Product photos are for illustration, and the item you receive may differ slightly in minor details.

We do not guarantee that product descriptions, images, or other Site content are completely accurate, complete, or error-free.

Prices

All prices are in U.S. dollars (USD). Prices, promotions, and discounts may change at any time without notice. Promotional offers apply only during the stated period and cannot be combined unless we say so. Sales tax and shipping costs, where they apply, are calculated at checkout before you complete your purchase.

Pricing and Listing Errors

If a product is listed at an incorrect price or with incorrect information because of a typographical, technical, or system error, we may correct the error and cancel any order placed on the basis of it, even after an order confirmation has been sent. If we cancel your order for this reason, we will notify you, and your Affirm loan will be cancelled.

Availability

All products are subject to availability. If an item you ordered becomes unavailable, we will notify you and offer a full refund or, where possible, a similar alternative.

5. Orders, Payment, and Affirm Financing

How Orders Work

Your order is an offer to buy. The confirmation email you receive means we have received your order, not that we have accepted it. We accept your order when it ships. We may refuse or cancel any order, including for suspected fraud, address verification problems, pricing errors, product unavailability, or orders that appear to be placed for resale.

Payment Through Affirm

All purchases on the Site are paid through Affirm, a third-party financing provider.

When you choose Affirm, you apply for financing directly with Affirm, and your loan is a separate agreement between you and Affirm.
Affirm alone decides whether to approve you, as well as the loan amount, interest rate, and repayment terms. Chad Staton is not a lender and has no control over Affirm’s credit decisions.

We process your order only after Affirm approves and confirms your purchase.

Your Payment Responsibilities

You are responsible for making all payments to Affirm under your loan agreement. Refunds are issued to Affirm, which applies them to your loan. Please keep making your scheduled payments until a refund shows in your Affirm account, as described in our Return & Refund Policy.

Fraud Prevention and Verification

To protect you and us, we may verify your identity, address, and order details before shipping. We may ship only to the address verified with your Affirm account. Orders that fail verification may be held or cancelled.

6. Shipping, Delivery, Returns, and Warranty

Shipping and Delivery

We ship to addresses in the 48 contiguous United States. Massage chairs are large and heavy and usually ship by freight with standard curbside delivery. Processing times, delivery scheduling, delivery requirements, and what to do if your delivery is damaged are explained in our Shipping & Delivery Policy. Risk of loss and title to the products pass to you when the carrier delivers them to your shipping address.

Inspection and Damage Reports

Please inspect your delivery before signing for it, and note any visible damage on the carrier’s receipt. You must report damaged, defective, or incorrect items to us within 48 hours of delivery.

Returns and Refunds

You may request a return within 30 days of delivery, subject to the conditions, fees, and procedures in our Return & Refund Policy. All returns must be authorized by us in advance.

Product Warranty

Products may be covered by a limited warranty, as described on the product page or in the documentation included with your product. The warranty does not cover damage caused by misuse, accidents, improper assembly, unauthorized repairs, commercial use, or normal wear and tear.

7. Health and Safety Use of Massage Chairs

Not a Medical Device

Our massage chairs are designed for general relaxation and personal comfort only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on the Site, including product descriptions and blog content, is medical advice.

Talk to a Doctor First

Please talk to a qualified healthcare professional before using a massage chair if you:

Are pregnant
Have a pacemaker or other implanted electronic medical device
Have heart disease, high blood pressure, or circulation problems
Have osteoporosis, a spinal condition, recent fractures, or recent surgery
Have skin conditions, open wounds, or inflammation in areas the chair will touch
Have any other medical condition or concern

Safe Use Requirements

Read and follow the user manual and all safety warnings before using the chair.
Do not exceed the chair’s stated maximum user weight or height.
Do not let children use the chair or play on or near it without supervision.
Do not use the chair for longer than the recommended session time.
Stop using the chair immediately if you feel pain, discomfort, numbness, or dizziness.
Unplug the chair when it is not in use and before cleaning or moving it.

You use our products at your own risk. We are not responsible for injury or damage caused by misuse, failure to follow the manual, or ignoring these warnings.

8. User Content, Intellectual Property, and Prohibited Conduct

Our Intellectual Property

The Site’s content, including text, page design, our logo, and graphics we created, belongs to Chad Staton or is used with permission, and is protected by U.S. copyright, trademark, and other intellectual property laws. Content provided by suppliers and manufacturers remains their property. Product names and trademarks of third parties, including Affirm, WordPress, and WooCommerce, belong to their respective owners, and their use does not imply any endorsement.

Reviews and Submissions

If you submit reviews, comments, photos, or other content to the Site, you:

Confirm that the content is honest, is your own, and does not infringe anyone else’s rights
Give us a non-exclusive, royalty-free, worldwide right to use, display, and reproduce that content on the Site and in our marketing materials

We may remove any submission that is false, offensive, unlawful, or in breach of these Terms of Service.

Prohibited Conduct

You agree not to:

Use the Site for any unlawful or fraudulent purpose
Place fraudulent orders or use another person’s identity, payment details, or Affirm account
Try to gain unauthorized access to the Site, its servers, or other users’ accounts
Upload viruses, malware, or other harmful code
Use bots, scrapers, or automated tools to collect data from the Site
Interfere with the Site’s security, performance, or normal operation
Buy products for resale without our written permission

9. Disclaimers, Limitation of Liability, and Indemnification

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no promise that the Site will be uninterrupted, secure, or free of errors or harmful components.

Limitation of Liability

To the fullest extent permitted by law:

Chad Staton will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products.
Our total liability for any claim relating to a product or order will not exceed the amount you paid for that product.

Some states do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you. Nothing in these Terms of Service limits any rights you have under applicable consumer protection laws.

Third-Party Services

The Site may link to or rely on third-party services, including Affirm and shipping carriers. We are not responsible for their content, policies, or practices, and you use them at your own risk.

Indemnification

You agree to indemnify and hold harmless Chad Staton and its owners, employees, and partners from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms of Service, your misuse of the Site or our products, or your violation of any law or the rights of any third party.

10. Governing Law, Disputes, Changes, and Contact Us

Governing Law

These Terms of Service are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules.

Resolving Disputes

If you have a dispute with us, please contact us first at support@chadstaton.store. We will try to resolve it informally within 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Cole County, Missouri, and you agree to the jurisdiction of those courts. Either party may bring an eligible claim in small claims court.

Changes to These Terms

We may update these Terms of Service from time to time. Changes take effect when posted on this page, with an updated Effective Date. Orders are governed by the Terms of Service in effect on the date of purchase. If you keep using the Site after changes are posted, you accept the updated Terms of Service.

General Terms

Entire agreement: these Terms of Service and the policies listed in Section 1 are the entire agreement between you and Chad Staton regarding the Site and your purchases.
Severability: if any part of these Terms of Service is found to be invalid or unenforceable, the rest will remain in full force and effect.
No waiver: if we do not enforce any part of these Terms of Service, we do not give up our right to enforce it later.
Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, carrier delays, supply chain disruptions, labor disputes, pandemics, or government actions.
Assignment: we may transfer our rights and obligations under these Terms of Service without your consent. You may not transfer yours without our written permission.
